Welcome to AutoXAU. By accessing or using our AI-powered trading platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using AutoXAU, you confirm that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You are not located in a jurisdiction where our Service is prohibited
• You agree to comply with all applicable laws and regulations

2. Service Description

AutoXAU provides:

• AI-generated trading signals for cryptocurrency and commodity markets
• Automated trading execution via connected broker APIs
• Market analysis and manipulation detection tools
• Portfolio management and risk controls

Important: Our Service provides trading signals and automation tools but does not guarantee profits. All trading involves substantial risk of loss.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring the accuracy of information you provide
• Notifying us immediately of any unauthorized access
• Securing your broker API keys and secrets

4. Risk Disclosure

TRADING CARRIES SIGNIFICANT RISK. You acknowledge and understand that:

• Past performance does not guarantee future results
• You may lose some or all of your invested capital
• Leverage and margin trading increase both potential gains and losses
• Market conditions can change rapidly and unpredictably
• Technical failures, including internet outages or API errors, may result in losses
• AutoXAU is not a financial advisor and does not provide personalized investment advice

You trade at your own risk. AutoXAU is not liable for trading losses.

5. Subscription and Payment

• Free Tier: Limited access to signals and analysis; no auto-trading
• Starter ($19/month): 1 broker connection, auto-trading, analytics
• Pro ($49/month): 3 broker connections, advanced strategies, priority support

Payments are billed monthly in advance. You may cancel at any time, but no refunds are provided for partial months. We accept credit cards (via Stripe) and cryptocurrency payments.

6. Broker API Connections

When connecting a broker API:

• Your API keys are encrypted and stored securely
• You grant AutoXAU permission to execute trades on your behalf when auto-trading is enabled
• You remain responsible for all trades executed through our platform
• You must ensure your API keys have appropriate permissions (trading, balance reading)
• We recommend using IP whitelisting and API key restrictions on your broker account

7. Prohibited Activities

You may not:

• Use the Service for illegal activities or market manipulation
• Attempt to reverse-engineer, hack, or compromise our systems
• Share your account with others or create multiple accounts
• Scrape, copy, or redistribute our signals without permission
• Interfere with the proper functioning of the Service
• Use the Service to compete with AutoXAU or build a similar product

8. Intellectual Property

All content, algorithms, models, and technology used in AutoXAU are our exclusive property or licensed to us. You may not copy, modify, distribute, or create derivative works without written permission.

9. Data and Privacy

We collect and use your data as described in our Privacy Policy. By using the Service, you consent to our data practices.

10. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Abuse of the Service

You may cancel your account at any time via the dashboard settings.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• AutoXAU is provided "AS IS" without warranties of any kind
• We are not liable for trading losses, missed opportunities, or technical failures
• Our total liability to you is limited to the fees you paid in the past 3 months
• We are not responsible for third-party services (brokers, payment processors)

12. Indemnification

You agree to indemnify and hold AutoXAU harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any laws or third-party rights.

13. Modifications to Terms

We may update these Terms at any time. We will notify users of material changes via email or dashboard notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Singapore. Any disputes will be resolved in the courts of Singapore.
